ABPI in the Participatory Legislation Commission

In a roundtable promoted on April 27 by the Participatory Legislation Committee of the Chamber of Deputies, the reporting director of the ABPI (Brazilian Intellectual Property Association) José Eduardo Pieri, reinforced the importance of the Complementary Law Project No. 143/2019, of the deputy Marcos Pereira, who determines that the resources destined to the INPI (National Institute of Intellectual Property) will not be subject to expenditure limitation. Bill 143/2019 follows a priority procedure and awaits the opinion of the Rapporteur in the Finance and Taxation Committee, deputy Luis Miranda.

In his testimony, the director of ABPI Pieri explained that the efficiency of the INPI, the Federal Autarchy, linked to the Ministry of Economy, is fundamental for him to exercise his responsibility for the improvement, dissemination and management of the Brazilian system for granting and guaranteeing industrial property rights. . “Despite being a surplus body, a large part of the resources is returned to the National Treasury with a view to obtaining a primary surplus. As a result, Brazilian society lives with an average period of 10 years for the examination and concession of patents by the INPI, a period far short of the need that technological innovation requires”, said Pieri.

“ABPI recognizes the recent efforts of the INPI with measures to improve its productivity, but believes that only the budgetary financial autonomy ensured by the Industrial Property Law (Law No. 9.279 / 96) is a definitive solution to equate the Brazilian autarchy with the most efficient ones. international patent offices, ”he added.
